These Terms of Service ("Terms") govern your use of the epicSPOTLIGHT website and all associated subdomains and web properties (collectively, the "Site"), as well as the AI Voice Widget and AI Calling platform services offered by epicSPOTLIGHT ("epicSPOTLIGHT," "we," "us," or "our").

By accessing the Site, subscribing to a plan, embedding our AI Voice Widget, using our AI Calling services, or otherwise engaging with epicSPOTLIGHT, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use the Site or our services.

These Terms apply to all visitors, users, subscribers, and businesses that access or use the Site or any epicSPOTLIGHT service.

epicSPOTLIGHT provides AI-powered voice engagement and calling services designed to help businesses capture leads, qualify prospects, book appointments, and automate outbound communication. Our services include:

• AI Voice Widget: An embeddable widget that sits on your website and engages visitors in real-time conversations, qualifies leads, books appointments, and follows up automatically — available 24/7 in 52+ languages.
• AI Calling Assistant: An inbound and outbound calling platform that manages lead qualification, appointment booking, CRM syncing, live call transfers, and follow-up campaigns at scale.
• CRM & Integration Support: Direct integrations with GoHighLevel (GHL), Salesforce, Zapier, and connected calendar platforms to automate lead data flow.
• Call Analytics & Recordings: Full transcripts, call recordings, sentiment analysis, and performance reporting for every AI interaction.

epicSPOTLIGHT is an independent AI technology platform. We are not a licensed healthcare provider, legal services firm, financial institution, or affiliated with any utility or government program.

To use our Site and services, you must:

• Be at least 18 years of age.
• Have the legal authority to enter into binding agreements on behalf of yourself or your business.
• Provide accurate and complete information in all account registrations, form submissions, and communications.
• Use our services in compliance with all applicable laws and regulations.

Submitting false, inaccurate, or fraudulent information may result in immediate suspension or termination of your account and access to all epicSPOTLIGHT services.

Plan Selection

epicSPOTLIGHT offers subscription plans — Basic ($97/mo), Growth ($197/mo), Professional ($297/mo), and Premium ($497/mo) — each providing different levels of access to our AI Voice Widget and AI Calling features. Plan details, included features, and pricing are described on our Site's pricing page and are subject to change.

Billing

By subscribing to a plan, you authorize epicSPOTLIGHT to charge your selected payment method on a recurring monthly basis. All fees are billed in advance. You are responsible for keeping your payment information current and accurate.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing cycle. We do not offer refunds for partial months or unused service periods, except where required by applicable law.

No Hidden Fees

epicSPOTLIGHT does not charge setup fees, long-term contract lock-ins, or cancellation penalties. Pricing is transparent and displayed on our Site.

You agree to use epicSPOTLIGHT's services only for lawful business purposes. You agree not to:

• Use our AI Voice Widget or AI Calling services to contact individuals without their prior consent, in violation of the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or other applicable communications laws.
• Submit false, inaccurate, or fraudulent information in any form or account registration.
• Use our services to harass, threaten, deceive, or defraud any individual or business.
• Scrape, harvest, or collect data from the Site using automated means without our written permission.
• Reverse engineer, decompile, or attempt to extract the source code of our platform.
• Resell, sublicense, or otherwise transfer access to our services without prior written consent.
• Interfere with or disrupt the operation of the Site or its underlying infrastructure.
• Use our services in any manner that violates applicable law, regulation, or third-party rights.

By submitting your phone number and/or email address through any epicSPOTLIGHT form, demo request, or AI Voice Widget, you expressly consent to receive:

• SMS/text messages from epicSPOTLIGHT and its AI assistant Sofia, including appointment confirmations, follow-up messages, and service-related communications.
• AI-generated voice calls regarding your inquiry, lead qualification status, or account activity.
• Email communications regarding your inquiry, subscription, and platform updates.

This consent is not a condition of purchase or platform access. You may opt out at any time by replying STOP to any text message or clicking "unsubscribe" in any email. Standard message and data rates may apply.

epicSPOTLIGHT provides AI-powered tools designed to improve lead capture, qualification, and conversion rates. However:

• We do not guarantee specific lead volumes, revenue outcomes, or conversion rates.
• Results vary based on your industry, website traffic, offer quality, and how our tools are configured.
• Statistics and benchmarks shown on our Site (e.g., "40-50 extra leads per month," "73% visitor-to-lead conversion rate") are based on reported client results and are not guarantees of individual performance.

epicSPOTLIGHT strives to provide accurate and up-to-date information on our Site, including feature descriptions, pricing, and platform capabilities. However:

• Platform features and pricing are subject to change without notice.

EPICSPOTLIGHT DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VULNERABILITIES OR HARMFUL COMPONENTS. AI-GENERATED CONVERSATIONS MAY CONTAIN ERRORS AND SHOULD BE REVIEWED BY YOUR TEAM FOR ACCURACY BEFORE ACTING ON THEM.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EPICSPOTLIGHT AND ITS OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST LEADS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO EPICSPOTLIGHT IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless epicSPOTLIGHT and its respective officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of and access to the Site or platform.
• Your violation of these Terms.
• Your violation of any applicable law or third-party right, including communications laws governing your use of our AI Calling and SMS features.
• Any claim that content or data you submitted through our platform caused damage to a third party.

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site or platform shall be resolved exclusively in the state or federal courts of competent jurisdiction. You consent to the personal jurisdiction of those courts.

epicSPOTLIGHT reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of the Site or platform after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
